1. ACCEPTANCE OF TERMS
Welcome to Fundraisher (“we,” “us,” “our”). By accessing or using our website at fundraisher.com (the “Site”), creating an Athlete Hub, Manager Account, Team Hub, or Partner Hub, or using any of our services, you (“User,” “you,” or “your”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you may not use the Site or our services.
These Terms constitute a legal agreement between you and Fundraisher, a Nevada company. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. DESCRIPTION OF SERVICES
2.1 Athlete Hubs
Fundraisher provides female athletes with personalized hubs (“Athlete Hubs”) to showcase their athletic journey, link to external fundraising campaigns, display team schedules and events, share media kits with potential sponsors, and connect with their supporter community. Athlete Hubs are accessible via custom URLs (e.g., fundraisher.com/athletehub/[your-slug]).
2.2 Manager Accounts
Manager Accounts allow parents, coaches, agents, or other authorized individuals to help manage Athlete Hubs on behalf of athletes. Managers can access Marketing Hub and Hub Builder features for up to 5 athletes with proper authorization.
2.3 Team Hubs
Team Hubs enable coaches, athletic directors, and team administrators to post events, fundraishers, and fan merchandise links that automatically display on all synced Athlete Hubs. Team Hubs are provided free of charge.
2.4 Partner Hub
Partner Hub allows verified brands, businesses, and agencies to browse athlete profiles, view media kits, and submit partnership inquiries. Partner Hub access is provided free of charge to verified partners. Partners must comply with our Partner Hub Guidelines (incorporated herein by reference).

3. ELIGIBILITY
3.1 Age Requirements
All users must be at least 18 years of age to create an account and use our services. Age verification is conducted through PayPal payment processing. Accounts created by individuals under 18 will be terminated without refund.
3.2 Athlete Verification
Athlete Hubs are exclusively for female athletes at all levels (recreational, amateur, student-athlete, professional, retired). We reserve the right to request verification of athlete status. If we cannot verify you as an active or retired female athlete, your account may be suspended or terminated, and your subscription cancelled without refund.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. SUBSCRIPTIONS, FEES & PAYMENT
4.1 Subscription Plans
Athlete Hub: $19.99 per month. Athlete Manager (add-on): $19.99 per month. Manager Account (standalone): $19.99 per month. Team Hub: Free. Partner Hub: Free. All paid subscriptions are billed monthly through PayPal.
4.2 Cancellation
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of your current billing period. No refunds will be provided for partial months. Cancelled accounts may lose access to certain features or data.
4.3 No Refunds
All subscription fees are non-refundable once paid. This includes situations where accounts are suspended or terminated for Terms violations.

5. THIRD-PARTY PAYMENT LINKS
5.1 No Payment Processing
IMPORTANT: Fundraisher does not collect, process, or facilitate any payments for campaigns or fundraishers. We are a “link aggregation platform” similar to Linktree. Athletes link to external fundraising platforms (GoFundMe, Venmo, PayPal, etc.), and all transactions occur on those third-party platforms.
5.2 User Responsibility
Users are solely responsible for the accuracy, security, and functionality of third-party payment links they list on their Athlete Hubs. We do not endorse, verify, or guarantee any third-party payment platforms. We are not responsible for any disputes, errors, fraud, or issues arising from transactions on third-party platforms.
5.3 Liability Disclaimer
We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party payment platforms. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of any such third-party services.

6. CONTENT GUIDELINES & USER CONDUCT
All content you post, upload, or share on your Athlete Hub, Team Hub, or through our services must comply with our Content Guidelines, which are incorporated into these Terms by reference. Prohibited content includes but is not limited to:
• Illegal content or activity• Hate speech, harassment, or discrimination• Violence, graphic content, or self-harm• Nudity or sexually explicit content• Spam, scams, phishing, or fraud• Misinformation or false claims• Intellectual property infringement• Private information without consent• Impersonation• Content glorifying harmful behavior
Violations may result in content removal, account warnings, suspension, or permanent termination without refund.

7. INTELLECTUAL PROPERTY
7.1 Your Content
You retain ownership of all content you upload to your Athlete Hub or Team Hub (“User Content”). By posting User Content, you grant Fundraisher a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Site and services. This license terminates when you delete the content or close your account, except where content has been shared by others.
7.2 Fundraisher’s IP
The Site, including all software, designs, text, graphics, logos, and other content (excluding User Content), is owned by Fundraisher and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without prior written consent.

8. PRIVACY & DATA PROTECTION
Your privacy is important to us. Our Privacy Policy (available at fundraisher.com/privacy-policy) explains how we collect, use, and protect your personal information. By using our services, you consent to our Privacy Policy. Key points:
• We collect minimal personal information (name, email, sport details, location)• We do NOT store credit card or payment information• Athlete Hubs are NOT indexed by search engines• Athletes control visibility of location and personal details• We never sell or share your data with third parties• CCPA & GDPR rights are respected

9. TAX RESPONSIBILITY
Users are solely responsible for reporting and paying any applicable federal, state, or local taxes on donations or payments received through third-party platforms linked on their Athlete Hubs. Fundraisher does not provide tax advice or tax documentation (e.g., 1099 forms). We recommend consulting with a qualified tax professional.

10. DISCLAIMERS & LIMITATION OF LIABILITY
10.1 Service “As Is”
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FUNDRAISHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY BUGS, VIRUSES, OR MALWARE TRANSMITTED THROUGH THE SITE; (D) ANY ERRORS OR OMISSIONS IN CONTENT; (E) USER CONTENT OR CONDUCT OF ANY THIRD PARTY; OR (F) ANY DEALINGS WITH THIRD-PARTY PLATFORMS.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO FUNDRAISHER IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Fundraisher, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any fraudulent or illegal activity.

12. TERMINATION
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms, fraudulent activity, or failure to verify athlete status. Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. DISPUTE RESOLUTION & GOVERNING LAW
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
13.2 Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Nevada before one arbitrator. Arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the arbitration award may be entered in any court having jurisdiction.
13.3 Class Action Waiver
YOU AND FUNDRAISHER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. AMENDMENTS TO TERMS
We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this document and notify users via email. Continued use of the services after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the services.

15. MISCELLANEOUS
15.1 Entire Agreement
These Terms, together with our Privacy Policy and Content Guidelines, constitute the entire agreement between you and Fundraisher regarding use of the services.
15.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
15.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
15.4 Assignment
You may not assign or transfer these Terms without our prior written consent. Fundraisher may assign these Terms without restriction.
