Athlete Brand Partner Marketplace & Outreach Policy
Applies to: Agents, managers, producers, brands, and other “Buyers/Partners” using Fundraisher to discover and contact female athletes (“Athletes”).
1) Purpose & scope
Fundraisher provides a searchable database so qualified partners can discover and contact Athletes for legitimate professional opportunities (e.g., sponsorships, appearances, UGC, content collaborations). This Policy governs how you may use the database and contact tools. If you don’t agree, do not use the database.
2) Who may use the database
-
You must be 18+, acting on behalf of yourself or an organization with authority to make offers.
-
You must provide accurate identity and contact details and agree to our verification checks.
-
Working with student-athletes: you agree to respect NIL rules and school conference policies.
-
We may deny, suspend, or revoke access at our discretion.
3) Permitted use (what you can do)
-
Search/filter profiles and send professional outreach through their Athlete Hub.
-
Evaluate Athletes solely for lawful, non-discriminatory opportunities.
-
Use profile info only to evaluate and contact the specific Athlete for the opportunity you submit.
4) Prohibited use (zero tolerance)
You may not:
-
Request unpaid work unless the context is clearly charitable/volunteer and disclosed upfront.
-
Harass, sexualize, demean, or fetishize Athletes; send romantic/explicit content; request sexual content.
-
Discriminate or screen based on protected characteristics (race, religion, disability, sexual orientation, gender identity, age, nationality, etc.).
-
Offer or solicit work in restricted categories for minors or student-athletes (e.g., alcohol, tobacco/vape, betting/gambling, adult content, illegal substances).
-
Scrape, harvest, or index the database; use bots; resell or republish profile data; use for AI model training without written consent.
-
Bypass platform safety features; spam (bulk/duplicative pitches); misrepresent who you are or the scope/budget.
-
Use athlete images/content without a separate, written license from the Athlete/rights holder.
5) Outreach rules (keep it professional)
-
One pitch = one clear opportunity (brand, deliverables, timeline, budget range, usage rights, exclusivity if any).
-
Respect opt-outs and “do not contact” flags.
-
Do not exceed 5 active open pitches per Athlete or 3 total per 7 days per organization.
-
No pressure tactics, threats, or attempts to move off-platform to avoid records or safety tools.
7) Student-athletes / NIL
-
You are responsible for NCAA/state/school NIL compliance (category restrictions, disclosures, booster rules).
-
Provide all required documentation for compliance reporting upon request.
-
No pay-for-play, recruiting inducements, or impermissible benefits.
8) Content, IP, and usage rights
-
Athletes own their content unless otherwise stated.
-
If you purchase content/UGC, spell out usage scope (channels, regions, paid media/whitelisting, term) and exclusivity in writing.
9) Privacy & data use
-
Use Athlete contact info only for the disclosed opportunity.
-
Do not build external databases or share Athlete info beyond your internal team for the specific engagement.
-
Comply with privacy laws (e.g., CCPA/GDPR) where applicable.
-
Athletes may request removal or correction of profile data; we reserve the right to notify partners who have received that data.
10) Payments, contracts, and disclosures
-
Fundraisher is not a party to your deals unless expressly stated. You are responsible for contracts, taxes, and compliance.
-
Follow FTC/ASA advertising rules: clear and conspicuous #ad disclosures; no false health/medical claims.
-
If using whitelisting/paid usage, obtain written consent and pay the agreed license fee.
-
No contingent payment on illegal or non-compliant terms.
11) Reviews, reporting & enforcement
-
You can report abuse or policy violations at hey@fundraisher.com.
-
We may investigate, remove content, suspend accounts, block outreach, and notify law enforcement if necessary.
-
Penalty ladder: warning → temporary suspension → permanent ban. Severe violations may skip steps.
12) Takedowns & disputes
-
IP complaints (DMCA/UK equivalents): send notices to hey@fundraisher.com with URLs, proof of rights, and contact info.
-
Defamation/harassment: report specifics with evidence.
We may remove or restrict content pending review.
13) Anti-scraping & rate limits
-
Automated access, scraping, copying, or exporting the database is prohibited.
-
We may implement rate limits, CAPTCHAs, watermarks, and trap data to detect misuse and pursue technical/legal remedies.
14) Accessibility & inclusion
Outreach and opportunities must be accessible and inclusive. Provide reasonable accommodations and avoid discriminatory criteria.
